Claim and Complaint Reporting

Am I required to report all circumstances that could give rise to a Claim?

Yes. As soon as you are aware of any circumstances, regardless of whether a lawsuit has been commenced, which may lead to a claim being made, or as soon as an actual claim is made, please notify the carrier per the instructions below.

How do I determine if something is qualified as a Claim?

The policy defines a claim as:

  1. A written demand for monetary relief; or
  2. A civil or arbitration proceeding for monetary relief which is commenced by:
    • Service of a complaint or similar pleading
    • Receipt or filing of an arbitration demand or statement of claim; or

What should I do if I have an E&O claim?

  • If a summons or formal written complaint has been issued, report the claim immediately to CNA. Please be sure to include your contact  info,  title,  phone  number,  and  case  or  claimant  name.
  • If Guardian Life or a Guardian Life subsidiary is involved, forward a copy of your cover letter to:

Reporting claims to the insurance carrier:

Arthur J Gallagher has a claims liaison on staff to assist you with any claims or complaints. You may contact our liaison after you have reported your claim or complaint to the carrier, if need be.
